What makes authority just?
Read the appointment of judges, the pursuit of justice, the law of the king, the protection of fruit trees, and the ritual of the broken-necked heifer, and ask how royal authority is bound by Torah, restraint, and responsibility.
Royal justice
Shoftim describes the institutions of a people in its land: judges, kings, priests, prophets. At every level, authority is placed under limits. The parashah is the Torah's charter for just rule.
This study accompanies the song for Parashat Shoftim, set at Malchut in Maqam Hijaz, royal justice. The law of the king has been connected by tradition to the future kingship of the house of David; we keep that connection marked as tradition. We read five passages.
1. In all your gatesא.
Deuteronomy 16:18 says, judges and officers you shall appoint for yourself in all your gates which HaShem your God gives you, for your tribes, and they shall judge the people with righteous judgment.
Justice is placed in every gate, close to where people live, and it requires both judges and officers who enforce. The verse addresses the people, you shall appoint for yourself. As our reading, just rule begins as a shared responsibility, not only as a gift from above.
2. Justice, justice you shall pursueב.
Deuteronomy 16:20 says, justice, justice you shall pursue, that you may live and inherit the land which HaShem your God gives you.
The word justice is doubled, and the verb is to pursue, not merely to keep. Many interpreters have read the doubling as a demand for just means as well as just ends. We offer that as a reading. The verse ties justice to life and to inheriting the land.
3. A king who writesג.
Deuteronomy 17:18-20 says, when he sits on the throne of his kingdom, he shall write for himself a copy of this Torah in a book. It shall be with him and he shall read in it all the days of his life, so that he may learn to fear HaShem his God, so that his heart not be lifted above his brothers, and that he not turn aside from the commandment.
The king's first act on the throne is to write and to read. The stated purpose is that his heart not be lifted above his brothers. As our reading, royal authority in the Torah is bound to study and humility; the king remains a brother among brothers.
4. Is the tree of the field a man?ד.
Deuteronomy 20:19 says, when you besiege a city many days to fight against it, you shall not destroy its trees by wielding an axe against them, for you may eat from them, and you shall not cut them down; is the tree of the field a man, to come before you in siege?
Even in war, power is limited: the fruit tree may not be destroyed. From this verse the tradition derived the broader prohibition of needless destruction, bal tashchit, which Rambam codifies; we cite it in general terms. As our reading, just authority knows what it must not destroy even when it can.
5. Our hands did not shed this bloodה.
Deuteronomy 21:7-8 says that the elders of the city nearest to a slain person found in the field shall declare, our hands did not shed this blood, and our eyes did not see. Grant atonement for your people Yisrael whom you redeemed, HaShem, and do not place innocent blood in the midst of your people.
The leaders of the nearest town must publicly account for an unsolved death. The Talmud asks why elders would be suspected, and answers that the declaration concerns whether the person was sent away without food and escort; we cite this generally. As our reading, authority is responsible even for what it did not directly do.
Authority under Torah
Our passages show just authority: judges at every gate, justice pursued with just means, a king who studies and stays a brother, power that refrains from needless destruction, and leaders who account even for what they did not do.
This week, in one place where you hold authority, at home, at work, or in a community, ask whose welfare you are responsible for even if you did not cause their trouble. Take one step of care for them.

- Why might justice be doubled in "justice, justice you shall pursue"?
- What does a king who must write and read a Torah teach about power?
- For what are leaders responsible even when they did not act directly?
