How does clear order become a form of care?

Learning objective

Read laws concerning the vulnerable and the enemy alongside the people's covenantal response, and ask how clear order can protect those most easily overlooked.

After the mountain, the details

After the thunder of Sinai, the Torah turns to details: servants, damages, loans, animals, courts. Mishpatim opens with the words, and these are the laws that you shall set before them. Revelation continues in the ordinary affairs of a society.

This study accompanies the song for Parashat Mishpatim, set at Chochma in Maqam Rast, the wisdom of clear order. We read four passages and ask how law can protect the vulnerable.

1. You were strangersא.

Exodus 22:20 says, do not wrong a stranger and do not oppress him, for you were strangers in the land of Egypt. The law gives a reason, and the reason is a memory.

The law does not ask the people to imagine a stranger's situation from nothing; it asks them to remember their own. Order is built here from experience. As our application, the memory of having been vulnerable can become a reason to protect others rather than a license to repeat what was suffered.

2. The widow and the orphanב.

Exodus 22:21-22 continues, you shall not afflict any widow or orphan. If you afflict him, and he cries out to me, I will surely hear his cry. The law moves from prohibition to a description of divine attention.

The doubled verbs, afflict afflict, cry cry, hear hear, give the passage intensity. The law is not neutral about whom it protects; it names those with the least power and binds their cry to a listener. This is a reading of the verse's emphasis.

3. Your enemy's oxג.

Exodus 23:4 says, if you meet your enemy's ox or his donkey going astray, you shall surely return it to him. Verse 5 adds, if you see the donkey of one who hates you lying under its burden, and you would refrain from helping him, you shall surely help with him.

Verse 5 anticipates the reluctance a person may feel, and you would refrain from helping, and then commands help anyway, and with him, together. The law does not demand affection for the enemy; it requires shared action in a moment of need.

4. We will do and we will hearד.

Exodus 24:7 says that Moshe took the book of the covenant and read it in the hearing of the people, and they said, all that HaShem has spoken we will do and we will hear.

The response comes after hearing a book of concrete obligations read aloud. The order we will do and we will hear has been interpreted in many ways; we note only that the people commit to practice, not merely to an idea.

Order that protects

Our passages show law that remembers, law that names the vulnerable, law that overcomes reluctance toward an enemy, and a people who accept it as a covenant. Clear order is not opposed to care here; it is one of the ways care becomes dependable.

This week, identify one fixed practice that would make your care for someone more dependable than your mood: a set call, a regular visit, a recurring act of help.

  1. Why might the Torah ground the law of the stranger in memory?
  2. What does the law of the enemy's donkey ask of us, and what does it not ask?
  3. Which fixed practice could make your care more dependable?
